1Strictly avoid conflicts of interest
To uphold the prohibition on representing conflicting interests (§ 39 PAO), Patai initially shows you only an anonymised preview of the technical field and context. Before you can view the full request (incl. real names and sensitive details), you are required to run a formal conflict check in your firm's system and confirm that no conflict exists.
2No free individual legal advice
No final legal advice in individual cases takes place via the platform. Your feedback serves as initial guidance and mandate initiation within the scope of permitted marketing (§ 39b PAO). The systematic provision of free, in-depth legal services for acquisition purposes is professionally prohibited. Use your feedback instead for qualified scoping (effort estimates, next steps, presentation of your firm's expertise).
3Maintaining confidentiality and novelty protection
As a patent attorney, you are bound by confidentiality obligations (§ 39a PAO). Since the principle of absolute novelty applies in patent law, treat all information obtained through Patai as strictly confidential. The system provides encrypted transmission — legal responsibility for protecting data after it has been accessed rests with you from the moment of access.
4Prohibition of success guarantees and misleading advertising
Your presentation and communication on the platform must be factual. Misleading advertising or the making of success guarantees (e.g. "We guarantee 100% patent grant") are prohibited under § 39b para. 1 PAO. Your feedback must reflect the actual legal and technical circumstances.
5Individual responsibility and mandate conclusion
A binding mandate relationship including liability arises exclusively through your final, explicit acceptance of a case vis-à-vis the user — not automatically through use of the platform. You act on Patai at all times under your own professional and liability responsibility (§ 45 PAO).
6Data protection and international mandates
As a recipient of inventors' personal data, you are yourself a data controller under the GDPR (Art. 4 No. 7) from the moment of access. Ensure that your firm has appropriate technical and organisational measures in place. For international requests (EPO, WIPO, USPTO), also observe the relevant national professional rules of the applicable jurisdiction — particularly regarding advertising restrictions and fee regulations.
Note for law firms: Patai does not charge success-based commission fees on referred mandates, in strict compliance with the prohibition on fee-sharing (§ 49b para. 3 BRAO / equivalent PAO). The platform is funded exclusively through neutral usage and infrastructure fees.
